Platform Terms and Conditions

1. Scope and order of precedence

These Platform Terms apply to a customer's use of Longitude6 workplace technology platforms, including MotionTrack6 (each a "Platform"), and are incorporated into the customer's signed agreement with Longitude6. "Longitude6", "we", "us" and "our" mean the Longitude6 entity named in that agreement.

If these Platform Terms conflict with the signed customer agreement, the signed customer agreement prevails. The website Terms of Use apply to the public website only.

2. License restrictions

You must not:

• modify, disassemble, decompile, or reverse engineer a Platform;
• attempt to gain unauthorised access to a Platform, user accounts, or any computer system or network associated with a Platform;
• use a Platform in any manner that could damage, disable, overburden, or impair Longitude6's servers or networks; or
• use a Platform for any purpose that is illegal or otherwise prohibited by your signed agreement.

3. Account terms

Where an account is required, you must provide accurate, current, and complete information and keep it up to date. You are responsible for keeping your account credentials confidential and for all activity under your account, and must notify Longitude6 immediately of any unauthorised use or security breach.

4. Trademarks and proprietary notices

Longitude6's trademarks and trade dress may not be used with any product or service without its prior written consent. If Longitude6 permits you to post, reproduce, or display any part of its platforms or content, you must identify Longitude6 as owner or licensor and display a proprietary notice on that posting, reproduction, or display.

5. Warranty disclaimer

To the extent permitted by law, Longitude6's platforms are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Longitude6 does not guarantee any platform will be error-free, uninterrupted, or fit for every purpose.

Nothing in these Platform Terms excludes any right or guarantee that cannot lawfully be excluded.

6. Product-specific terms

MotionTrack6

Reports and guidance generated by MotionTrack6 are for internal informational purposes only and are not professional medical advice. They must not be relied upon as the sole basis for any employment, safety, or other decision affecting a Participant.

Participant Terms and Conditions (MotionTrack6)

This section applies directly to the Participant completing a MotionTrack6 assessment, separate from the Customer's acceptance of these Platform Terms as a whole.

By starting a MotionTrack6 assessment, the Participant acknowledges that: the assessment is not medical advice and does not diagnose, treat, or replace professional medical consultation; results are provided to the Customer who requested the assessment and used as described in the Participant Privacy Policy; and participation is at the Participant's own risk, to the extent permitted by law.

The Participant's personal information, including any data collected through the assessment, is handled as described in the Participant Privacy Policy, which the Participant should read before participating.

SMS Terms

If a Participant opts in to receive SMS text messages as part of a MotionTrack6 assessment, the following terms apply: by ticking the SMS consent option, the Participant agrees to receive text messages from Longitude6 (MotionTrack6), on behalf of their employer, about their MotionTrack6 assessment, including assessment links, reminders and schedule changes, at the mobile number provided. Message frequency varies, usually about one message per assessment. Message and data rates may apply. The Participant can opt out at any time by replying STOP, or get help by replying HELP. SMS consent is optional and is not required to complete the assessment; the Participant can receive assessment communications by email instead.

7. Entire agreement

These Platform Terms, together with the signed customer agreement and Longitude6's Privacy Policy, constitute the entire agreement between the parties on that subject matter, and supersede all prior discussions or agreements on it.

8. General terms

Severability

If any provision of these terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Assignment

You may not assign or transfer these terms, or any rights or obligations under them, without Longitude6's prior written consent. Longitude6 may assign these terms freely, including to a successor of its business.

Force majeure

Neither party is liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, internet or utility outages, or government action.

9. Notices

Notices under these terms must be given in writing to the contact details set out in your signed agreement, or, for Longitude6, to admin@longitude6.com.

10. Privacy

Our handling of personal information is described in the Privacy Policy. People participating in a workplace assessment should also read the Participant Privacy Policy.
